
Success Before The Lahore High Court
Expertos Legales is pleased to share a notable success before the Lahore High Court secured by our Managing Partner, Mr. Muhammad Farooq Rashid.
The matter involved an important jurisdictional question arising under the Trade Marks Ordinance, 2001 following the 2023 amendment to Sections 16 to 18, whereby the expression “District Court” was introduced and objections began to be raised regarding the continued jurisdiction of the Intellectual Property Tribunal in revocation and invalidation proceedings. The case therefore raised a significant point of law concerning the proper interpretation of the amended provisions of the Trade Marks Ordinance in harmony with Section 18 of the Intellectual Property Organization Act, 2012.
In a significant outcome, the Lahore High Court accepted the appeals, set aside the impugned orders, and affirmed, in effect, that the amendment did not extinguish the jurisdiction of the Intellectual Property Tribunal over such intellectual property matters. The proceedings were accordingly remitted to the learned Tribunal to continue from the stage at which they had earlier been returned.
This outcome is important not merely because the appeals succeeded, but because it contributes to much needed clarity in Pakistan’s intellectual property jurisprudence by reaffirming the statutory role of the Tribunal and preserving procedural certainty in trademark disputes.
